An ACT TO AMEND THE PUBLIC SERVANTS (LIABILITIES) ORDINANCE

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:
|

short title.

1. This Act may be cited as the Public Servants (Liabilities) (Amendment) Act, No. 11 of 1990.
|
|
Amendment of section 2 of the Chapter 103.
|
2. Section 2 of the Public Servants (Liabilities) Ordinance is hereby amended by the insertion, immediately after subsection (5) of that section, of the following new subsection :
|
" (5A) This section does not apply to any liability contracted by a public servant who has failed to disclose to the lender that he is a public servant or has stated that his occupation or employment is other than that of a public servant in response to any inquiry made of him by the lender with respect to his occupation or employment, prior to the contracting of the liability sought to be enforced against him.".

Sinhala text to prevail in case of inconsistency.
|
3. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
