AN ACT TO AMEND THE ARMY ACT.

BE It enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Representatives of Ceylon in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1. This Act may be cited as the Army (Amendment) Act, No. 22 of 1971.

Insertion of new section. 156B in Chapter 357.

2. The Army Act, hereinafter referred to as the " principal Act " is hereby amended by the insertion, immediately after section 156A (Inserted by Act No, 22 of 1964), of the following new section:-

' Special provisions relating to the payment of pensions and gratuities to widows and families of certain deceased members of the Ceylon Defence Force.

156B. Section 17 of the Defence Force Ordinance, No. 8 of 1910, as amended by Ordinance No. 5 of 1945, which is deemed to be In force by virtue of the provisions of the preceding section of this Act shall, for the purposes of awarding a pension or gratuity to the widow or family of such officer or soldier as is referred to in the aforesaid section 17, be deemed always to have had effect subject to the following amendment, that Is to say, the substitution, for the words " who dies within seven years of sustaining or contracting such wound, injury or disease: " in paragraph (c) of sub-section (1) of the aforesaid section 17, of the words " who dies as a result of such wound, injury or disease: ". and accordingly a pension or gratuity may be awarded to any such widow or family in accordance with the provisions of the aforesaid section 17 as so amended.'.

Retrospective operation of the amendment made in section 2.

3. The amendment made in the principal Act by section 2 of this Act shall he deemed, for all purposes, to have had effect on the date on which Ordinance No. 5 of 1945, came into operation:

Provided however that, where any widow or family of any officer or soldier becomes eligible for a pension by virtue of the aforesaid section 17 as so amended, such pension shall-

(a) in a case where the death of the officer or soldier has occurred prior to the first day of October, 1968, be payable only with effect from the first day of October, 1968, and

(b) in a case where the death of the officer or soldier has occurred on or after the first day of October, 1968, be payable from the day following the date of death.
